The lessees of blocks of flats or conversions are quite often not satisfied with the management or condition of their buildings. Reason for the same might be high service charges or proposed major works. One way which could be of some help while dealing with this situation is for the Lessees to exercise their statutory right to manage their building (subject to certain pre-conditions) through a right to manage company. It is important to note that this is a right – the Lessor doesn’t have to be necessarily at fault. Another point to be considered is that the procedure does not involve an application to the court.
We have the expertise to give advice on whether the right to manage is the best way of addressing Lessees’ concerns, on the pre-conditions and on the procedure.
