Right of First Refusal

RIGHT OF FIRST REFUSAL

The usual position is that in case a landlord of a building containing flats wants to sell his interest, his tenants must be given the right of first refusal. Not doing so without a reasonable excuse amounts to a criminal offence, and in addition the lessees have the right to compel the landlord’s purchaser to sell to them.
Our team gives advice regarding rights of first refusal; particularly landlords’ and lessees’ respective rights and obligations, the notices that must be served, timing and enforcement.
